市民的及び政治的権利に関する国際規約の選択議定書（日本未批准・外務省仮訳）
Optional Protocol to the International Covenant on Civil and Political Rights (not ratified by Japan)
日本は、B規約人権委員会から、「選択議定書」の批准を勧告されている。
Japan has been recommended by the Human Rights Committee to ratify the above Optional Protocol.
下記「最終見解」33節に、「委員会は、締約国が人権侵害の被害者を救済するための措置をとること、特に、規約の選択議定書を批准することを勧告する。 」とある。
Paragraph 33 of the following "Concluding observations" reads "The Committee recommends that the State party take measures to provide remedies to victims of violations of human rights and, in particular, that it ratify the Optional Protocol to the Covenant."

EU（欧州連合）に比べるとぐっとなじみの薄いCoEですけど，実は日本は「オブザーバー」だったりします。上記のサイトから引用します。
5．我が国との関係
（1）常設オブザーバー・ステータス
我が国は、95年9月、CEの常設オブザーバー・ステータスを申請し、96年11月、アメリカ、カナダに次いで3番目のオブザーバー国となった。また、99年12月、メキシコが4番目のオブザーバー国となった。我が国は、閣僚委員会の補助機構であるレポーター・グループ（RG）の全て（民主的安定、欧州安全保障協力機構（OSCE）、司法協力、人権等に関する各RGその他）並びに運営委員会・専門家会合等閣僚委員会の全ての下部組織へ原則として参加できる。 また我が国は､欧州人権担当大臣会議､欧州男女平等問題担当大臣会議等の専門大臣会議や法律による民主主義のための欧州委員会(ヴェニス委員会)・南北センター等の部分協定会合にも出席。

この中に，
"Any State willing to accept the
principles of democracy, the rule of law and the enjoyment by all
persons within its jurisdiction of human rights and fundamental
freedoms, and wishing to co-operate with the Council of
Europe may be granted by the Committee of Ministers, after
consulting the Parliamentary Assembly, observer status with the
Organisation."

principes de la démocratie et de la prééminence
du droit et le principe en vertu duquel toute personne placée
sous sa juridiction doit jouir des droits de l'homme et des
libertés fondamentales et qui est désireux

P対Sおよびコーンウォール・カウンティ・カウンシル事件で争点になった。ヨーロッパ（司法）裁判所は，「TSであるとかSRSを行ったとして解雇することは，雇用に際し男女同等の扱いの原則を求めている当指令にいう性による差別を構成する」と判断した。
